Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date:

• On which you or a third party designated by you (other than the carrier) have taken possession of the goods, provided you ordered one or more items in a single order and these are delivered together.

• On which you or a third party designated by you (other than the carrier) have taken possession of the last item, provided you ordered multiple goods in a single order and these were delivered separately.

To exercise your right of withdrawal, you must inform us of your decision by email: support@lussomoda.net. You may use the attached withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the 14-day period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will issue store credit for all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different delivery method than the cheapest standard delivery offered by us). The store credit will be provided immediately and no later than 14 days from the day we receive your withdrawal notice.

We may withhold the store credit until we have received the returned goods or until you have provided proof that you have sent the goods, whichever is earlier.

You must return or hand over the goods immediately and no later than 14 days from the date you notified us of the withdrawal. The deadline is met if you send the goods before the two-week period expires.

You bear the direct costs of returning the goods.

You will only be liable for any diminished value of the goods if this results from handling beyond what is necessary to determine their nature, characteristics, and functionality.

Sale items are excluded from returns and are not eligible for store credit.

Exclusions and Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

• For the supply of goods made to order or clearly customized to the consumer’s specific needs.

• For the supply of perishable goods or goods with a short shelf life.

• For the supply of alcoholic beverages where the price was agreed upon in the contract but delivery cannot take place before 30 days and their value depends on market fluctuations beyond the seller’s control.

• For the supply of newspapers, periodicals, or magazines, except for subscriptions.

The right of withdrawal expires early in contracts:

• For the supply of sealed goods that are unsuitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.

• For the supply of goods that have been inseparably mixed with other goods after delivery due to their nature.

• For the supply of audio or video recordings and computer software in sealed packaging, if the seal was removed after delivery.
